Duluth, MN (KDAL) - Jim Carlson’s efforts to seek a new trial have been stopped. That’s after the Judge who presided over the embattled head shop owner's trial denied his motion for a retrial Tuesday. Judge David S. Doty also denied the retrial and acquittal motions for Carlson’s co-defendant’s Lava Haugen and Joseph Gellerman. Both are free on bond while Carlson remains held in jail. A sentencing date has not been scheduled. In October a jury found the owner of The Last Place on Earth guilty of 51 of the 55 federal counts against him. Guilty verdicts were handed down to Haugen for the four counts against her and to Gellerman for two of the four counts he was charged with.
